Lalit Modi Wins FEMA Case Appeal
Former IPL chairman Lalit Modi received major legal relief after an appellate decision reversed the Enforcement Directorate’s sentence against him in the 2009 IPL South Africa case.
The verdict was issued on July 16 by the Appellate Tribunal under the Smugglers and Foreign Exchange Manipulators (Forfeiture of Property) Act (SAFEMA).
The tribunal’s division bench, led by Chairman Justice Munishwar Nath Bhandari and Member Rajesh Malhotra, released a 105-page ruling noting that Modi was not in command of the events and was framed in the case despite the lack of proof of his involvement.
The dispute stems back to 2009, when security concerns around India’s general elections made it difficult to arrange the IPL season domestically, so it was moved to South Africa.
The ED alleged that the BCCI violated the Foreign Exchange Management Act (FEMA) by moving $49.86 million in foreign currency to a foreign company without first obtaining Reserve Bank of India approval.
However, the tribunal found no material evidence to suggest that Modi was responsible for the alleged FEMA violations.
What was Lalit Modi’s response to the tribunal’s decision?
Lalit Modi was ecstatic following the judgement. Modi’s counsel, Mehmood Abdi, issued a formal statement expressing satisfaction with the tribunal’s decision.
I was solely worried with the well-being of the IPL and nothing and nothing at all. That is the most precious to me. According to Business Today, Modi stated, “Now that chapter is behind me, I’m going to move on in my life, and I’m looking forward to coming back to India.”
He also stated, “For over sixteen years, I have consistently maintained one simple position: I acted in good faith, in the best interests of Indian cricket and the IPL, and committed no personal wrongdoing.”
Lalit Modi, through his counsel, stated that the verdict emphasised the need of following the proper legal process and performing an objective study of evidence.
When is Lalit Modi going to visit India again?
Lalit Modi stated that the timing of his return would be determined by his immediate objectives and family situation. He expressed excitement about returning to India, expecting to do so by the end of this year or the beginning of the next.
Modi departed India in 2010, when the BCCI, the Income Tax Department, and the Enforcement Directorate were conducting investigations. Following his departure in 2010, the tribunal’s decision brought an end to a protracted legal battle that had lasted over 16 years.
